Section 4 (1) (b) of RTI Act 2005, in particular, requires every
public authority to publish information under following sixteen categories
(I) The particulars of its organization, functions and duties Brief history of the APTEL (Appellate Tribunal for Electricity)
The Appellate Tribunal for Electricity (APTEL) commenced its functions, including the hearing of appeals and petitions, on 21st July 2005, as per the notification issued by the Ministry of Power dated 19th July 2005.
The Appellate Tribunal comprises of the Chairperson and four Members. Of these, two are Technical Members and one is a Judicial Member, as mandated by the Electricity Act, 2003. Additionally, one Technical Member is designated for Petroleum and Natural Gas matters. The first Chairperson of the Tribunal was Hon’ble Mr. Justice Anil Dev Singh, who assumed office on 13th May 2005, alongside Hon’ble Mr. Justice E. Padmanabhan as Judicial Member, and Hon’ble Mr. A.A. Khan and Hon’ble Mr. H.L. Bajaj as Technical Members.

Objective and Purpose
The Electricity Act, 2003 (Act No. 36 of 2003), was notified by the Government of India on 10th June, 2003. The Act consolidates the laws pertaining to the generation, transmission, distribution, trading, and utilization of electricity. It aims to foster the development of the electricity industry, promote competition within the sector, safeguard consumer interests, ensures universal electricity access, rationalizes electricity tariffs, establish transparent subsidy policies, encourages efficient and environmentally sustainable practices, constitutes the Central Electricity Authority and Regulatory Commissions, and establishes the Appellate Tribunal for Electricity. The Act extends to the entirety of India, excluding the Union Territory of Jammu and Kashmir.
Pursuant to Section 110 of the Electricity Act, 2003, the Appellate Tribunal for Electricity, possessing jurisdiction pan India, was established. This tribunal is empowered to adjudicate appeals or original petitions against orders issued by Adjudicating Officers, the Central Electricity Regulatory Commission, State Electricity Regulatory Commissions, or Joint Commissions. Furthermore, the Tribunal exercises original jurisdiction to hear petitions under Section 121 of the Act and to issue directives to any Appropriate Commission regarding the performance of its statutory functions. The Ministry of Power, Government of India, established this Tribunal, which commenced operations on 7th April, 2004, as notified vide S.O. 478(E). The principal seat of the Tribunal is located in Delhi.
Duties and Functions
The Appellate Tribunal for Electricity hears and adjudicates upon appeals filed pursuant to Section 111 of the Electricity Act, 2003, contesting orders issued by the Central Electricity Regulatory Commission (CERC), Joint Electricity Regulatory Commissions (JERCs), and State Electricity Regulatory Commissions (SERCs). Such appeals are to be disposed of within a period not exceeding one hundred and eighty (180) days from the date of filing.
Furthermore, APTEL possesses jurisdiction to entertain and adjudicate upon appeals filed under Section 33 of the Petroleum and Natural Gas Regulatory Board Act, 2006, challenging orders issued by the Petroleum and Natural Gas Regulatory Board. These appeals shall be disposed of within a period not exceeding ninety (90) days from the date of filing.
The principal functions of the Appellate Tribunal for Electricity are to receive and adjudicate appeals filed under the Electricity Act, 2003, and the Petroleum and Natural Gas Regulatory Board Act, 2006. These appeals contest orders issued by the Central, Joint, and State Electricity Regulatory Commissions, as well as the Petroleum and Natural Gas Regulatory Board.
APTEL is mandated to dispose of appeals within the statutory time frames of one hundred and eighty (180) days and ninety (90) days, respectively.
List of duties and functions of APTEL with a brief write-up
- Receiving appeals under Section 111 of Electricity Act 2003 through physical / E-filling mode.
- Receiving appeals under section 33 of the Petroleum and Natural Gas Regulatory Board Act, 2006 through physical / E-filling mode.
- Receiving appeals under Section 31 (1) of Energy conservation through physical / E-filling mode.
- Receiving caveat applications, Interim applications, Review Petitions, Contempt petition, original petition.
- Issuing of defect letters to counsels.
- After defect curing by the parties/counsels, listing of fresh matters, Review Petitions, Contempt petition, original petition before Court.
- Intimation to the appellants/applicants/counsels/parties through notice and email, about listing of cases before court.
- Preparing of cause list and uploading of the same on the website apart from pasting it on the notice boards of the Tribunal.
- Hearing of appeals, application, IAs, Review Petitions, Contempt petition, original petition by the Bench.
- Uploading of judgements/ daily orders on the website of APTEL i.e., www.aptel.gov.in.
- Disposal of appeals, application, IAs, Review Petitions, Contempt petition, Original petition by the Bench.
- The report regarding pendency/disposal is forwarded to Ministry of Power on monthly/quarterly/yearly basis.
- Copy of judgement is sent to respective commissions /boards.
- Communication about disposal of cases is sent to all parties/counsels.
- Issuance of certified copies on applications by counsel/parties.
- Applications received and disposed in RTI by CPIO (Dy. Registrar).
Appeals received and disposed in RTI by First Appellate Authority (Registrar).
Upon filing of an appeal, a comprehensive examination is conducted to ascertain its compliance with the Electricity Act, 2003, and the Petroleum and Natural Gas Regulatory Board Act, 2006. The submitted documentation is meticulously scrutinized to verify adherence to statutory limitations, prescribed formatting, and the payment of requisite court fees. In instances of procedural defects, a formal notification, detailing the deficiencies, is issued, affording the appellant a reasonable period for rectification. After the satisfactory correction of any identified defects, the appeal is assigned a unique identification number and scheduled for presentation before the court.
APTEL’s Organizational Structure
The Appellate Tribunal for Electricity (APTEL) conducts judicial proceedings in open court. Currently, two courts are functional. Each court is constituted of a Judicial Member and a Technical Member. The Tribunal adjudicates cases arising under both the Electricity Act, 2003, and the Petroleum and Natural Gas Regulatory Board Act, 2006.

Chairperson: Same powers as conferred on a Department of the Central Government.
Registrar: Head of the Department.
Director (Adm): Head of Office.
Duties of Officers and employees
Registrar: S/he is responsible for smooth conduct of business of the Tribunal and in-charge of administration and Registry. S/he is vested with the powers of Head of the Department and is assisted by the Director (Administration) and Deputy Registrars.
Director (Administration): S/he is responsible for the functioning of the Administration as well as the Accounts Branch and has also been given the powers of the Head of the Office. S/he is assisted by the Administrative & Accounts Officer.
Deputy Registrar (I & II): Deputy Registrars perform functions delegated by the Registrar. They oversee day to day work of the registry and e-courts. Deputy Registrars maintain smooth functioning of the Registry.
